Readers of the Affiliate Project X ebook will have learnt about a method involving targeting product names. If you’re going to use that particular tactic then you need to be aware of the potential risks.
I’m not in a position to provide you with legal advice, but there have been enough publicised cases of trademark infringment to make me think twice about using them.
Some of the affiliate programs I participate in have strict rules about the use of registered trademarks. Merchants may suspend or even terminate your affiliation (together with any pending commission) if they find you’ve infringed their trademarks in your promotional efforts.
If you’re thinking about using peoples trademarks without their express permission, even if you’re promoting their products, then it’s your own responsibility to ensure you know which side of the line you’re treading on.
